General Terms and Conditions

The following General Terms and Conditions apply to all offers, contracts, deliveries, and other services of World Consulting Service Ltd Inc. – 2701 Centerville Road – Wilmington – DE 19808 – USA.

Any deviating terms and conditions of our contractual partners are hereby expressly rejected; they shall only apply with our explicit written consent. All side agreements require our written confirmation to be valid.

1. World Consulting Service Ltd Inc. – 2701 Centerville Road – Wilmington – DE 19808 – USA, is the issuer of the WCS hotel vouchers. The hotel voucher entitles the holder to a basic service consisting of accommodation for two persons in a double room at a partner hotel, for the number of nights specified on the respective voucher. The overnight stay is paid for with the voucher. Local taxes or other local charges are not included in the hotel voucher. In addition to this basic service, the voucher may also be redeemable for various, regularly changing hotel specials and travel specials. These hotel or travel specials differ from the basic service and are described either on this website or other mediums, provided they are currently available.

2. The currently available partner hotels are presented on this website. WCS reserves the right to change the hotel offerings, to permanently or temporarily remove partner hotels from the program (e.g., due to high booking volume), and to add new partner hotels. There is no entitlement to redeem the hotel voucher at a specific partner hotel.

3. This website also displays temporary hotel specials and travel specials that change continuously. These are additional offers to the basic service and may contain different service components. The voucher holder is principally entitled only to the basic service but may make use of the specials if they are explicitly offered.

4. The user of the hotel voucher is obliged to accept the mandatory meal package per person and per night when booking a hotel stay for two persons. The cost of the meal package is not included in the voucher and must be paid in advance as per the booking confirmation. Even if breakfast and/or meals are only partially used or not used at all, the user must still pay the full booked amount. The respective starting prices are listed for each hotel on the website. Some hotels may offer alternative meal packages, which will be indicated accordingly and serve as the basis for the specific booking.

Definition and Design of the Meal Package for Voucher Bookings:
Booking and payment of a mandatory meal package is a prerequisite for redeeming a hotel voucher at a partner hotel. This package is not part of the voucher’s value and must be paid separately before arrival.

The meal package includes at least half-board (breakfast and dinner) or a higher-quality option and may also include additional services often bundled in regular hotel prices, such as:

  • Wi-Fi or internet access
  • Parking
  • Access to spa, wellness, or fitness areas
  • General operating and infrastructure costs
  • Service charges or local surcharges

Due to technical or operational reasons, these extra services cannot be itemized and are included in the package price. Therefore, the meal package is not directly comparable to standard meal services in regular hotel offers.

The rate is dynamically determined by each hotel based on seasonal timing, occupancy, demand, hotel category, regional specifics, and other market-relevant parameters. During peak seasons or periods of high demand, the price may be higher.

Only the official rack rates of the hotels serve as a valid basis for price comparison. Special promotions, discounted allocations from third-party providers, exclusive club benefits, or status-related discounts are excluded.

5. Hotel bookings must be made exclusively through the booking department and the prescribed booking method (see section 6 of these terms and/or the usage policy). Advance booking periods may apply. The accommodation contract is directly between the user and the hotel. Travel specials or travel offers must also be booked through the designated channel.

6. A hotel booking or inquiry is only valid if the traveler submits a booking request through the account of the voucher holder, using the provided booking request form. The voucher holder must be logged into their account. Vouchers must be registered beforehand and linked to a user account. Booking requests submitted via other channels (phone, email, fax, or mail) will not be processed. A booking is valid only upon receipt of a confirmed booking and after timely payment.

7. All bookings are subject to the availability of rooms allocated for voucher guests. Hotels may allocate different room capacities to different providers. It is therefore possible that one provider has no availability while another does. Availability can change at any time, e.g., due to cancellations. WCS has no control over this and cannot guarantee availability at a specific time or hotel.

8. A reservation is only guaranteed once confirmed in writing by the hotel or the WCS booking department.

9. All price details, conditions, and hotel descriptions are provided by the participating hotels or WCS booking partners (e.g., incoming agencies). WCS is not liable for their accuracy or completeness, nor for typographical errors. Hotel offers and terms may change at any time without prior notice. Users are responsible for checking the current conditions before booking.

10. As the accommodation contract is between the guest and the hotel, WCS is not liable for deficiencies, non-performance, or delayed services by the hotel. Claims relating to the stay, including cancellations, reductions, or compensation, must be directed to the hotel.

11. If a booking has been made with a contract hotel, the user must adhere to it. In case of cancellation or shortened stay, the hotel or WCS may charge up to 100% of the agreed meal package for the unused days. For fixed booked extra days or accompanying persons, cancellation charges are based on the hotel’s terms.

12. Vouchers are valid for up to 60 months from the date of issue and must be redeemed within that period. Unused vouchers after the expiration date are not eligible for refund or extension. Vouchers are single-use and non-refundable for cash. WCS is not liable for lost vouchers.

13. The user agrees that personal data required for the business process may be stored electronically by WCS and shared with the hotel and other involved or affiliated service providers.

14. Retention of Title
a. We retain ownership of all delivered goods (retention goods) until full payment of all current and future claims arising from the contract and business relationship with the customer.
b. The customer may not pledge or assign the retention goods as security. Ownership may only be transferred to third parties once all claims have been fully paid.
c. The customer hereby assigns all claims and ancillary rights related to resale, as well as insurance claims, to us in advance. In case of export, all claims against domestic or foreign banks—particularly from collections, letters of credit, or guarantees—are also assigned to us. If retention goods are sold together with other items, the claims are assigned proportionally based on the invoice value.

d. The customer is authorized and obligated to collect claims arising from resale despite the assignment, as long as we have not revoked this authorization. The amounts collected must be immediately transferred to us up to the amount of the claims due to us.

e. We are entitled at any time – even without withdrawing from the contract and without setting a grace period – to demand the return of the reserved goods, without the customer being entitled to any right of retention or refusal of performance due to already rendered payments.

f. The customer is obligated to maintain the reserved goods in proper condition.

15. In addition to these general terms and conditions, the terms of use for the hotel vouchers apply and are deemed accepted without exception by the user upon redemption of the vouchers.

16. The purchase and use of hotel vouchers are subject exclusively to U.S. law.

17. Deviating from the provisions stated above, separate terms apply for Hotel Specials and Travel Specials. The liability and cancellation terms of the respective provider apply.

Special Terms and Conditions for Reservations/Bookings Completed Online by the User:

Scope:
The following terms apply in addition to the general terms and conditions and terms of use between the user (hereinafter referred to as "customer") and WCS – World Consulting Service Ltd Inc., 2701 Centerville Road, Wilmington, DE 19808 USA, for the reservation, booking, mediation, and payment of hotel and accommodation services ("accommodations") made through the direct online booking feature on the website. The user completes the booking entirely on their own responsibility and liability.

These specific terms also apply even if they conflict with any general terms and conditions of the customer. They will not be accepted, even if WCS – World Consulting Service Ltd Inc. provides services in knowledge of these customer terms, unless otherwise expressly agreed.

Important Notice Regarding Possible Additional Hotel Costs:

Please pay attention to any notices regarding additional charges when reviewing search results. These indicate hotels where extra charges may apply on-site at the time of booking. These may include mandatory fees (e.g., local taxes, tourism fees) or optional services (e.g., parking, wellness).

We strongly recommend contacting the hotel directly or checking the official hotel website (if available) for detailed information.
It is your responsibility to obtain timely and complete information about such additional charges before completing a booking.

As a pure intermediary, we are not liable for any direct or indirect costs incurred in connection with additional services or local fees. You are solely responsible for checking these costs before booking.

By using the booking function, you expressly and legally agree to this provision, including the waiver of any objections.
If you do not agree, we kindly ask you not to proceed with a booking via this platform.

Mediation and Conclusion of Accommodation and Travel Service Contracts:

The service consists of mediating and concluding an accommodation or travel service contract.

If the customer books accommodations or travel services through WCS – World Consulting Service Ltd Inc., WCS acts solely as an intermediary for third-party services. WCS does not provide its own or third-party travel services and is therefore not considered a tour operator. WCS is not responsible for the contractual fulfillment of the booked services and does not assume any warranty in this regard.

If multiple accommodations are booked through WCS's internet portal, the selection and combination of accommodations are made solely by the customer.

If the customer books for themselves:
The accommodation contract is concluded directly between the customer and the provider of the selected accommodation ("provider"). For this purpose, WCS transmits the customer's personal data to the provider or its agents.

If the customer books for someone else:
The accommodation contract is concluded exclusively between the person using the services (or their employer, in the case of business travel) and the provider. The customer guarantees that they are authorized to conclude the contract on behalf of the third party. If this authorization is lacking, the customer is liable to WCS and the provider for any resulting damages if the third party refuses to fulfill the contract.

All rights and obligations arising from the accommodation or travel service contract exist solely between:

  1. The customer (if booking for themselves), or the traveler or their employer (in case of business travel), and
  2. The provider.

No contractual relationship regarding accommodations or travel services exists between the customer and WCS.

Accommodation Categories and Descriptions:

All descriptions and information about accommodations are provided by the providers themselves. WCS has no influence over this information and accepts no liability for its accuracy or completeness.

Categorization is based on the provider’s own classification system, and WCS assumes no responsibility for it.

Bookings and Reservations:

All bookings are forwarded by WCS as a declaration messenger on behalf of the customer. Accurate and complete information (e.g., travel dates, name, contact details) is essential. If a hotel identifies incorrect or incomplete information, it may cancel the booking.

Resale of bookings made via WCS for commercial purposes is strictly prohibited. This includes resale at higher prices. WCS reserves the right to exclude such users from future bookings and to cancel bookings. The provider may also cancel in such cases, and cancellation fees or damages must be borne by the customer.

A pre-reservation becomes valid immediately upon booking, and a confirmation is shown on screen.
If a deposit is required, the customer must pay it independently. Failure to pay on time may result in cancellation. Not paying the deposit does not release the customer from the obligation to cancel properly or to pay any resulting cancellation fees.

Cancellation Policy:

For "non-refundable rates," no cancellation or modification is possible.

Otherwise:

  • Cancellation up to 31 days before arrival is free.
  • Cancellations, modifications, no-shows, or early departures from 30 days before arrival onward incur 100% of the total cost.

Accommodation Prices:

Unless otherwise stated, all prices refer to the accommodation per night. Additional services may incur extra charges.
Providers are obliged to show the final price including taxes. However, the price is set solely by the provider.
Applicable taxes and local fees for accommodations abroad depend on local regulations. WCS accepts no responsibility for pricing accuracy.

Prices already reflect the voucher conditions and apply only to voucher or annual pass holders.

Third-Party Services:

WCS may engage external service providers (e.g., for payment processing). These providers are selected carefully and are subject to WCS's instructions and monitoring. They are also bound by the same confidentiality and data protection obligations as WCS.

WCS may implement technical or organizational changes based on market standards or regulatory requirements.

Changes and Cancellations:

Customers are responsible for canceling in accordance with the applicable terms. Cancellation terms vary depending on the provider and booking type. Any cancellation or change must occur before the cancellation deadline.

Providers may charge for shortened stays. Free cancellation may be excluded for special rates or last-minute bookings.

To prevent abuse, WCS reserves the right to cancel a reservation if the customer cannot be reached or has a history of cancellations/no-shows. In such cases, there is no entitlement to accommodation.

Warranty and Liability:

WCS has compiled its own information with the greatest care but cannot guarantee against data entry or transmission errors.
Reproducing or using this information beyond the intended purpose requires WCS's explicit written permission.

The information available on the WCS – World Consulting Service Ltd Inc. website is partially provided by the respective providers, other customers, or third parties. Likewise, WCS – World Consulting Service Ltd Inc. accepts no liability for defects or damages that occur in connection with the accommodation services provided by the provider. WCS – World Consulting Service Ltd Inc. makes no guarantees regarding the fulfillment of specific customer requests and assumes no liability in this regard.

a) are due to a culpable breach of essential contractual obligations – i.e., obligations the fulfillment of which is essential to the proper execution of the contract and on which the customer regularly relies,

b) are caused by gross negligence or willful misconduct by WCS – World Consulting Service Ltd Inc., or

c) involve injury to life, body, or health, liability under product liability law, or other statutory mandatory liability provisions.

If WCS – World Consulting Service Ltd Inc. is liable for a culpable breach of essential contractual obligations without gross negligence or willful misconduct, the liability shall be limited to the type and scope of damage that WCS – World Consulting Service Ltd Inc. could typically foresee at the time the contract was concluded, based on the known circumstances.

Warranty and damage claims expire no later than one year after the date the customer became aware of the damaging event. This does not apply to claims arising from tort (unlawful acts).
